The processing of personal data is subject to the EU General Data Protection Regulation (GDPR). This data protection notice informs you how Fresenius SE & Co. KGaA and its affiliated companies ("we" or "Fresenius") process personal data of you as an applicant on our application platform ("Platform") and which data are involved.
"Personal data" means all information about you as an applicant.
"Processing" means any operation performed upon personal data, such as collection, storage, organisation, structuring, adaptation or alteration, retrieval, consultation, use, disclosure, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

The controller responsible for processing your personal data is the company that has advertised the respective job. You will find the company name and contact details of this company in the respective job advertisement under "Contact person" or "Contact".
According to the GDPR, we are obliged to provide you with the contact details of the data protection officer. You can contact the data protection officer by sending a letter to the postal address of the controller for the attention of the Data Protection Department or by e-mail via dataprotection@fresenius.com.
You must create a user account to manage your application data. When creating the user account, you must provide a valid e-mail address and assign a password. This information is stored in the respective user account. To verify your e-mail address, we will send you an e-mail with the confirmation link. Your user account will only be activated after you have clicked on the confirmation link. To log in to a created user account, you must enter your user name and password.
In your user account you can store your application details and upload documents ("application data"). You can have the data from your CV automatically imported into the input mask of the platform. You can also use the application data stored in your user account for any subsequent applications to us without having to enter these data again.
Your application data will be forwarded directly to the respective department as well as to affiliated companies, provided that the respective position to be filled is located there or the decision on a possible recruitment is made there.
Fresenius uses an online psychological recruitment test for applicants applying for trainee and dual student positions. The provider of the online recruitment test is Aivy GmbH. Applicants can take the online recruitment test on the website or in the mobile application of Aivy GmbH. Fresenius sends an individual link to the online recruitment test to each applicant by e-mail. Participation in the online recruitment test is mandatory for applicants.
In order to enable the participation of the applicants in the online recruitment test, Fresenius transmits the applicant ID with the corresponding job ID to Aivy GmbH. After conducting the online recruitment test, Aivy GmbH will notify Fresenius of the test result for each applicant ID. In this respect, Aivy GmbH acts as a processor of Fresenius. When deciding whether to invite the applicant for an interview, the employees of Fresenius Human Resources department take the results of the online recruitment test into account. This is not an automated decision-making process within the meaning of Article 22 GDPR.
In relation to the performance of the online recruitment test and the provision of its mobile application and website, Aivy GmbH acts as an independent data controller. For more information on the processing of personal data by Aivy GmbH, please refer to its privacy notice at aivy.app/datenschutz.

We process your application data for the decision on the establishment of the employment relationship. The legal basis is Article 6 (1) (1) (b) in conjunction with Article 88 (1) GDPR and section 26 (1) BDSG German Federal Data Protection Act (BDSG).
In addition, we use your application data to fulfil our legal obligations towards the employees' representatives. The legal basis is Article (6) (1) (1) (c) GDPR in conjunction with Article 88 (1) GDPR and section 26 (1) BDSG as well as section 99 German Works Constitution Act (BetrVG).
If you provide information about your disability, we process it in order to inform the representative body for severely disabled persons about your application. The legal basis is Article 9 (2) (b) GDPR in conjunction with Article 88 (1) GDPR and section 26 (3) BDSG as well as section 164 (1) (4) German Social Code (SGB) IX.
If you withdraw your application or receive a rejection from us, we will retain your application data for the establishment, exercise or defence of legal claims under the German General Act on Equal Treatment (AGG). The legal basis is Article 6 (1) (1) (f) GDPR, if applicable, in conjunction with Article 9 (2) (f) GDPR.
In addition, we process your application data, e.g., to perform aggregated reports for the human resources processes. The legal basis is Article 6 (1) (1) (f) GDPR.
We use cookies to ensure the essential functions of the platform. The legal basis is section 25 (2) (2) German Telecommunications Telemedia Data Protection Act (TDDDG) and Art 6 (1) (1) (b) GDPR.
In order to fulfill the aforementioned purposes, we may share your personal data in whole or in part with other group companies and/or service providers. In addition, the following categories of recipients may receive your personal data:
In order to fulfill the aforementioned purpose, we may transfer your personal data to recipients outside Germany. Transfers within the European Economic Area (EEA) always take place in accordance with the uniform EU data protection level.
Transfers to third countries are always carried out in compliance with the supplementary requirements of Article 44 et seq. GDPR.
Your personal data may be transferred to certain third countries for which an adequacy decision of the EU Commission determines that an adequate level of protection exists in accordance with the uniform EU level of data protection. As a rule, EU standard contractual clauses (“SCC”) are concluded with the recipient for transfers to other third countries. These have been issued by the EU Commission to safeguard such international data transfers.
To transfer personal data outside the EEA among group companies of the business segments Fresenius Kabi (Fresenius Kabi AG and its affiliated companies) and Fresenius Corporate, we implemented binding corporate rules (“BCR”) approved by the data protection authorities in accordance with Article 47 GDPR. A copy of the SCC and the BCR can be requested via dataprotection@fresenius.com.
Ultimately, personal data may be transferred on the basis of an exceptional circumstance under Article 49 GDPR.
If you do not click on the confirmation link that we send to your e-mail address after creating your user account within 30 days, your user account will be deleted.
Before you have submitted your application, you can delete your user account with all personal data at any time. After submitting your application, your personal data will be stored for the duration of the application process. If you conclude an employment contract with Fresenius, your application documents will be transferred to your personnel file. If you receive a rejection or withdraw your application, we will subsequently store your personal data for a period of 6 months. After the retention period has expired, your personal data will be deleted.
You must provide your personal data which are required for your application to be considered. The mandatory fields are marked accordingly. If you do not provide your personal data, we will not be able to consider your application.
According to the GDPR, you are entitled to various rights. You have the right to access your personal data (Article 15 GDPR, sections 34 et seq. BDSG), to correct incorrect personal data (Article 16 GDPR), to delete your personal data under certain circumstances (Article 17 GDPR, section 34 et seq. BDSG) and to restrict the processing of data under certain circumstances (Article 18 GDPR).
If the processing is based on a contract and carried out by automated means, you have the right to receive personal data you provided to us in a structured, commonly used, machine-readable format and to transmit your personal data to another controller (Article 20 GDPR)
You also have the right to lodge a complaint with a supervisory authority, in particular, in the Member State of your habitual residence, place of work or of an alleged infringement of the GDPR (Article 77 GDPR in conjunction with section 19 BDSG). The responsible data protection authority for Fresenius is "Der Hessische Beauftragte für Datenschutz und Informationsfreiheit", Postfach 3163, 65021 Wiesbaden. The right of appeal is without prejudice to any other administrative or judicial remedy.
